Please read these Terms & Conditions carefully and in their entirety before using jdbwellbeing.wixsite.com/jdbwellbeing or purchasing any service or product offered by JDB Wellbeing LLC. By using this Site or making a purchase, you agree to be bound by these Terms & Conditions.

This website and its content are owned and operated by JDB Wellbeing LLC, doing business as four brands: JDB Wellbeing, Unfold, Gather & Glow, and Cultivate Studio (together referred to as the “Company,” “We,” “Us,” or “Our”). These Terms & Conditions govern your access to and use of jdbwellbeing.wixsite.com/jdbwellbeing (the “Site”) and all services, classes, sessions, programs, and products offered by us under any of our brand names.

By using the Site in any capacity, you voluntarily agree to these Terms & Conditions. If you have any questions, please contact us at jdbwellbeing@gmail.com.

Adults (18 and older) may use this Site and participate in our Services independently. Minors under the age of 18 are welcome to participate in our Services with the express written consent of a parent or legal guardian, as set out in our Minor Participant Policy & Consent Form. If you are a minor browsing this Site unaccompanied, please speak with a parent or trusted adult before signing up for any Activity.

These Terms & Conditions contain a Dispute Resolution clause requiring mediation followed by binding arbitration. By agreeing to these Terms & Conditions, you voluntarily waive your right to a jury trial.

1. Definitions

“Company,” “We,” “Our,” or “Us” means JDB Wellbeing LLC, including its four trading names: JDB Wellbeing, Unfold, Gather & Glow, and Cultivate Studio, and our website, jdbwellbeing.wixsite.com/jdbwellbeing. These Terms & Conditions apply equally to all services and products offered under any of these brand names.

“Content” means any and all written, visual, video, or audio information contained on the Site, including emails from JDB Wellbeing LLC, and any written or downloadable material purchased, viewed, or otherwise offered through the Site, including blog posts, graphics, newsletters, designs, guides, templates, and materials.

“Personal Information” means information that can be used on its own or with other information to identify, contact, or locate a person, including your name, address, email address, and telephone number.

“Services” means coaching and consulting services, sound bath sessions, yoga classes, group sessions, workshops, retreats, programs, digital products, and any other offerings provided by JDB Wellbeing LLC through the Site, in person, or via virtual/online platforms, including Zoom and similar video conferencing tools.

“Site” means jdbwellbeing.wixsite.com/jdbwellbeing and all associated pages, tabs, landing pages, forms, and sub-pages.

“You” or “Your” means the user, customer, participant, or viewer of the Site.

2. Consent

By using the Site and/or making any purchase or booking, you voluntarily agree to act in accordance with these Terms & Conditions, our Privacy Policy, and our Disclaimer.

Adults (18 and older) may use the Site and participate in our Services independently. Individuals under the age of 18 are welcome to participate in our Services, but may only do so with the express written consent of a parent or legal guardian. A parent or legal guardian must review and sign the JDB Wellbeing LLC Minor Participant Policy & Consent Form on behalf of any minor participant before that minor may attend any Activity, session, or program, whether in person or online.

We do not knowingly collect personal information from children under the age of 13 without verified parental consent. See our Privacy Policy for full details.

3. International Users

This Site is operated from Doylestown, Pennsylvania, United States. It is accessible to users worldwide, and we welcome visitors from all countries. However, by using this Site, you agree that your use is governed by the laws of the Commonwealth of Pennsylvania, United States, regardless of where you are located.

If you access this Site from outside the United States, you do so at your own initiative and are solely responsible for compliance with your local laws. To the extent that your local laws grant you rights that cannot be waived by contract, those rights are not affected by these Terms & Conditions. In all other respects, these Terms & Conditions apply to you in full.

International users whose personal data is collected through this Site should refer to our Privacy Policy, which addresses GDPR rights for EU residents and other applicable data protection obligations.

4. Virtual & Online Sessions

JDB Wellbeing LLC offers virtual and online sessions, including sound baths, yoga classes, coaching sessions, and group programs, conducted via Zoom and other video conferencing platforms. By participating in any virtual or online session, you agree to the following additional terms:

Your Environment

You are solely responsible for ensuring that your physical environment is safe before and during any virtual session. This includes, but is not limited to:

Ensuring you have adequate space to move freely and safely for any movement-based session.
Removing trip hazards, sharp objects, or other dangers from your immediate area.
Ensuring you are in a quiet, private space where you can participate without distraction or interruption, particularly during sound bath sessions.
Using headphones or speakers at a comfortable, safe volume. Excessive sound volume during virtual sound baths can cause hearing discomfort or harm. You are solely responsible for managing your own audio levels.

Technology & Platform Terms

Virtual sessions are hosted on third-party platforms such as Zoom. By participating, you acknowledge that:

JDB Wellbeing LLC is not responsible for technical difficulties, connection issues, platform outages, or any other technology failures that may interrupt or prevent your participation.
Your use of Zoom or any other third-party platform is subject to that platform’s own terms of service and privacy policy. JDB Wellbeing LLC is not responsible for the data practices of any third-party platform.
Refunds will not be issued for missed or interrupted sessions due to technology failures on your end.

Recording of Virtual Sessions

JDB Wellbeing LLC may record virtual sessions for quality, training, or archival purposes. You will be notified at the beginning of any session that is being recorded. By remaining in the session after that notification, you consent to being recorded. If you do not consent, you must leave the session and contact us at jdbwellbeing@gmail.com to arrange an alternative.

You may not record, screenshot, or capture any virtual session without the prior written consent of JDB Wellbeing LLC. Unauthorized recording violates our intellectual property rights and these Terms & Conditions.

Minor Participants in Virtual Sessions

Minor participants attending virtual sessions must have a parent or legal guardian present in the same physical location throughout the session, or must have provided verified written consent from a parent or legal guardian as set out in the JDB Wellbeing LLC Minor Participant Policy & Consent Form. JDB Wellbeing LLC facilitators are not responsible for monitoring minor participants’ physical safety in an unsupervised home environment during virtual sessions.

5. Minors — Participation Policy

JDB Wellbeing LLC welcomes participants of all ages across all of its brands. Minors under the age of 18 may participate in any Activity, session, or program, subject to the following conditions:

A parent or legal guardian must complete and sign the JDB Wellbeing LLC Minor Participant Policy & Consent Form before the minor participates in any Activity.
For in-person sessions, a parent or legal guardian must be present on site or, at minimum, reachable by phone throughout the session, as specified in the Minor Participant Policy.
For virtual sessions, a parent or legal guardian must be present in the same physical location as the minor throughout the session.
Minors under the age of 13 may only participate with a parent or legal guardian physically present at all times.
JDB Wellbeing LLC reserves the right to decline participation by any minor if the required consent forms have not been completed or if, in the facilitator’s reasonable judgment, participation would not be appropriate or safe for that individual.

The parent or legal guardian signing on behalf of a minor accepts all terms of these Terms & Conditions, the Participant Waiver, and the Minor Participant Policy on behalf of themselves and the minor, and assumes full responsibility for the minor’s participation.

6. Site Rules

By using the Site and/or making any purchase, you agree not to:

Abuse or harass any person through or in connection with the Site.
Post or transmit obscene, offensive, defamatory, or abusive content, or content that infringes our intellectual property rights or those of any third party.
Use the Site in any way that violates any applicable law, whether in the United States or in the jurisdiction in which you are located.
Post or transmit spam or any unsolicited content.
Post copyrighted materials or content that does not belong to you.
Promote or sell your own content, services, or products through the Site without our written permission.
Copy, download, share, post, or transmit our intellectual property in any way that infringes our rights.

General Wellness Disclaimer

Jennifer Bergbauer and JDB Wellbeing LLC offer coaching, sound bath, and yoga services. We are not licensed physicians, therapists, psychologists, or medical professionals. Nothing on this Site or in our Services constitutes medical advice, diagnosis, or treatment.

By using this Site or participating in our Services, you acknowledge and agree that:

You must consult with a qualified medical professional before beginning any coaching program, yoga practice, or sound healing session, particularly if you have a pre-existing health condition, are pregnant, or are recovering from surgery or injury.
Any information, guidance, or suggestions we provide are for informational and educational purposes only and are based on our personal experience and training.
You are solely responsible for any decisions or actions you take based on information received from us or through the Site.

Mental Health Disclaimer

Our coaching services are not a substitute for professional mental health treatment, therapy, counseling, or psychiatric care. If you are experiencing a mental health crisis, please seek help from a licensed mental health professional immediately.

Our Services are not designed to diagnose, treat, cure, or prevent any mental health condition, and participation in our programs does not create a therapeutic relationship.

Yoga & Physical Activity Disclaimer

Yoga and other movement practices carry an inherent risk of physical injury. By participating in any yoga class or movement session offered by JDB Wellbeing LLC, you voluntarily assume all risks associated with that activity. You agree to:

Inform your instructor of any injuries, medical conditions, or physical limitations before class begins.
Listen to your body and work within your own limits at all times.
Consult your physician before beginning any new physical activity, particularly if you have cardiovascular conditions, joint problems, or any other health concern.

JDB Wellbeing LLC, its instructors, and affiliates are not liable for any injury, illness, or adverse effect resulting from participation in yoga or movement-based sessions.

Sound Bath & Sound Healing Disclaimer

Sound healing sessions using tuning forks, singing bowls, and other instruments carry specific contraindications. By participating in any sound bath or sound healing session, you confirm that you have read and understood the following contraindications and have disclosed any applicable conditions to your practitioner prior to the session.

IMPORTANT: Do not participate in a sound healing session if any of the following apply without first obtaining written clearance from your physician.

Do NOT use sound healing instruments on or near:

Any deep vein thrombosis or known thrombi.
Open wounds.
Acute inflammations or tumors.
A pacemaker or defibrillator — maintain a minimum distance of 20 cm (approx. 8 inches) from the implant site.
Any metallic implant or in its immediate area, including screws and artificial joints.
Post-surgery sites before sutures have been removed and the scar is fully healed.
The neck area in cases of carotid atherosclerosis.
Inflamed joints and veins.
Inflammatory skin disorders or weeping eczema.
Diseased veins.
The stomach or back of a pregnant woman.

The following individuals must consult their doctor before participating in any sound healing session:

Individuals with carotid stenosis (prior to application near the carotid artery or larynx).
Individuals with cardiac pacemakers, artificial heart valves, or cardiac arrhythmias.
Individuals with a stent or shunt.
Individuals with a deep brain stimulation device (DBS) or any other electronic implanted medical device.
Individuals with epilepsy or any seizure disorder, including audiogenic epilepsy.
Pregnant individuals at any stage.
Individuals with cochlear implants or other hearing devices.
Individuals with severe tinnitus, hyperacusis, or acute ear conditions.
Individuals experiencing an active mental health crisis, including acute psychosis or active suicidal ideation.
Individuals who have recently undergone surgery or sustained an acute physical injury.

By attending a sound bath or sound healing session offered by JDB Wellbeing LLC, you confirm that none of the above contraindications apply to you, or that you have obtained written medical clearance and disclosed your condition in advance. JDB Wellbeing LLC and Jennifer Bergbauer are not liable for adverse effects arising from any failure to disclose relevant medical conditions.

8. Your Consent to These Terms & Conditions

By using this Site, or purchasing, downloading, or booking any Service, you voluntarily agree to these Terms & Conditions as stated here.

9. Changes to These Terms & Conditions

We reserve the right to change or update these Terms & Conditions at any time without prior notice to you. When changes are made, we will update the “Last Updated” date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms & Conditions. If you do not agree, please stop using the Site.

10. Links to Third-Party or External Websites

The Site may contain links to third-party websites. These links are provided for your convenience only. We are not liable for any information on third-party websites, their privacy practices, or any information you provide to them. You are responsible for reviewing and agreeing to any external website’s privacy policy or terms of use.

The Site and all of its Content are the intellectual property of JDB Wellbeing LLC, protected by United States copyright and trademark laws, as well as applicable international intellectual property laws. This includes all text, graphics, logos, brand names — including JDB Wellbeing, Unfold, Gather & Glow, and Cultivate Studio, each a separate trading name of JDB Wellbeing LLC — session materials, program content, worksheets, and other materials created by Jennifer Bergbauer or JDB Wellbeing LLC. Violations of these rights will be legally pursued to the fullest extent permitted by law.

12. Our Limited License to You

If you view, access, or purchase our Services, you are considered our Limited Licensee. You agree that our Site and its Content have been developed after a significant investment of time, money, education, and expertise.

You may not use the Site or any of its Content in any manner that is unauthorized, contrary to these Terms & Conditions, or that violates applicable intellectual property laws, unless we have authorized such use in writing in advance.

13. Your License to Us

By commenting on the Site or submitting content to JDB Wellbeing LLC via contact form, email, or social media, you represent that you are the lawful owner of that content. You grant us a non-exclusive license to use your comments or submissions in connection with our business purposes, including testimonials and marketing.

When purchasing from the Site or our Services, you agree not to distribute, copy, or share any content or materials in violation of these Terms & Conditions. You may share the Site for personal purposes, provided you link directly to it and give appropriate credit. You may not imply that you created, contributed to, or are associated with JDB Wellbeing LLC or any of its trading names (JDB Wellbeing, Unfold, Gather & Glow, or Cultivate Studio) in any misleading way.

16. No Claims Made Regarding Results

All testimonials, statements, or examples used by us are illustrative only. They are not guarantees that you will experience the same results. Each client and their circumstances are unique. Nothing should be interpreted as a guarantee of any specific outcome resulting from use of our Services.

17. Disclaimer — No Warranties, Guarantees, or Representations

We do not offer any warranties of any kind regarding the Site or our Services. All Services, Content, and materials are offered “AS IS” and without warranties, either express or implied, to the fullest extent permitted by applicable law.

18. Your Release of Us

By using the Site or purchasing, downloading, or using our Services, you agree to release, forgive, and forever discharge JDB Wellbeing LLC, Jennifer Bergbauer, its subsidiaries, employees, agents, contractors, subcontractors, and affiliates from any and all claims, suits, actions, charges, demands, liabilities, damages, judgments, and/or costs, whether known or unknown, both legal and equitable, in any manner.

19. Errors & Omissions

Every effort is made to provide up-to-date and accurate information on the Site and through our Services. However, due to the evolving nature of wellness topics, JDB Wellbeing LLC cannot warrant that all information is free from errors or is fully up to date at all times. You should conduct your own due diligence and consult qualified professionals as appropriate.

20. Refund Policy

We are committed to providing high-quality services and will do everything reasonable to ensure your satisfaction. Due to the nature of our offerings:

Refunds will not be issued for coaching sessions, sound bath sessions, or yoga classes that have already been rendered or attended.
Refunds will not be issued for digital products or downloadable content once access has been granted.
If you need to cancel or reschedule a session, please contact us at jdbwellbeing@gmail.com as soon as possible. Cancellations made with sufficient advance notice may be eligible for rescheduling at our discretion.

If you have questions or concerns about a service you received, please contact us at jdbwellbeing@gmail.com, and we will do our best to address them.

21. Payment & Purchases

When you purchase a Service or product from us, you will be charged through our payment processing platform. By completing a purchase, you authorize JDB Wellbeing LLC to charge the applicable amount to your selected payment method.

If you elect an installment or “pay over time” option at checkout, you agree that JDB Wellbeing LLC has permission to automatically charge the agreed amounts on the agreed dates without checking with you before each transaction.

If your payment method fails or is declined, you will lose access to the applicable Service or product. You remain responsible for the full purchase amount regardless of a declined payment.

We do not accept chargebacks as a substitute for contacting us directly to resolve a dispute. If a chargeback is filed without prior contact, we reserve the right to report the incident to credit reporting agencies, which may negatively affect your credit report. To have any such report removed, please contact us to arrange payment of the outstanding amount.

Payment processing companies may have their own privacy policies. We are not responsible for their policies or for circumstances beyond our control that may affect your payment method. You release us from any and all damages related to your use of our payment processing providers.

22. Limitation of Liability

JDB Wellbeing LLC is not responsible or liable in any way for any direct or indirect damages arising from your use of, purchase from, or participation in our Site or Services. We do not assume liability for damages, injuries, harm, misuse of information, or failure to properly use information, due to any act or failure to act by you.

Your sole and exclusive remedy for any negligence, failure to perform, or breach by us shall be a refund of the amount paid for the applicable Service or product. IN NO EVENT SHALL JDB WELLBEING LLC BE LIABLE FOR ANY INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES.

23. Defense & Indemnification

You shall, at all times, indemnify, defend, and hold harmless JDB Wellbeing LLC, Jennifer Bergbauer, and all of our shareholders, officers, members, affiliates, contractors, subcontractors, directors, assignees, employees, and licensees from and against all losses, damages, injuries, delays, deaths, lost profits, and expenses arising out of any proceeding: (a) brought by a third party or by JDB Wellbeing LLC; (b) arising out of your breach of your obligations, representations, warranties, or covenants under these Terms & Conditions or the Privacy Policy; or (c) arising out of any alleged breach or negligence said to have been committed by us.

24. Dispute Resolution — Mediation & Arbitration

If you have any complaints or if any issue arises in connection with the Site or our Services, please contact us first by emailing jdbwellbeing@gmail.com. We genuinely want to resolve concerns informally and quickly.

Step 1 — Informal Resolution

Please reach out to us directly. We will make every good-faith effort to resolve your concern within 30 days of receiving written notice.

Step 2 — Mediation

If we cannot resolve your dispute informally within 30 days of your initial written notice, both parties agree to participate in good-faith mediation before a mutually agreed-upon mediator in or near Doylestown, Pennsylvania, or via video conference if mutually agreed. The costs of mediation shall be shared equally.

Step 3 — Binding Arbitration

If mediation fails to resolve the dispute within 60 days of commencement, you agree to submit the dispute to binding arbitration administered by the American Arbitration Association (AAA), in accordance with the AAA’s then-current rules, before a mutually agreed-upon arbitrator.

By agreeing to this clause, you understand that you are waiving your right to a jury trial. Any arbitration hearing shall be held within 15 miles of Doylestown, Pennsylvania. The maximum award that can be issued to you is a refund of amounts paid to JDB Wellbeing LLC for the applicable Service or product. You may not seek additional, consequential, or punitive damages.

25. Governing Law

These Terms & Conditions, and any dispute arising out of them, shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. This applies to all users of the Site regardless of their location.

26. Consent to Jurisdiction

You irrevocably consent to the exclusive jurisdiction and venue of any Federal Court in the United States District Court for the Eastern District of Pennsylvania, or a state court located within the Commonwealth of Pennsylvania, in connection with any matter arising out of these Terms & Conditions, Privacy Policy, Disclaimer, or as a result of your use, download, or purchase from the Site or our Services.

27. Consent to Service

You irrevocably agree that process may be served on you in any manner authorized by the laws of the Commonwealth of Pennsylvania, and you waive any objection which you might otherwise have to service of process under Pennsylvania law.

28. Termination of Your Use

At our sole discretion, we may terminate your use of or access to the Site, Services, and any purchased content if you abuse, violate, or breach any of these Terms & Conditions, our Privacy Policy, our Disclaimer, or any other terms to which you have agreed.

29. Entire Agreement

These Terms & Conditions, our Privacy Policy, and our Disclaimer constitute the entire agreement between you and us with respect to the Site and Services. They supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us.
